West Virginia mesothelioma patient denied lump sum payment by insurer

Gordon Conley of Charleston, West Virginia has been diagnosed with malignant mesothelioma as a result of working with asbestos during his time as a artificial plant operator as well as electrician for Union Carbide. He was awarded a substantial amount for his injury claim, though he does not want the exact amount to be publicized.

The award is being administered by Wells Fargo Disability Management. Conley’s lawyer requested that Wells Fargo distribute the money in a lump sum, but he is instead receiving tiny monthly payments over the course of several years. The problem is that Conley likely will not survive to receive the sum of those payments. Wells Fargo could legally pay him a lump sum up front, but so far they possess stated that the case is under review as well as possess not responded to the attorney’s requests since April.

Mesothelioma is a rare but humorless form of cancer caused by asbestos exposure. Conley is expected to live only a matter of months. Incase he does not receive all of his benefits before he dies, his wife faces a series of legal complications in order to receive the remainder of the money.
