Joseph S. Marcell of Stratford, Connecticut will be paying over $11,000 in civil penalties as well as cleanup costs related to excavation of heavily contaminated soil. Marcell’s mother owns Stratford Self Storage, an undeveloped commercial property that is heavily contaminated with asbestos, lead as well as PCBs. The state Department of Environmental Protection (DEP) as well as federal Environmental Protection Agency (EPA) banned any excavation of the area, but Marcell defied the ban by digging in May 2009. Attorney Common Richard Blumenthal as well as the DEP obtained a court order to halt the excavation. Cleanup of the site took three days.
