Court upholds largest mesothelioma verdict in Recent Jersey history

The Recent Jersey Appellate Court has upheld a substantial jury award for the family of Mark Buttitta, who died of mesothelioma at the age of 50 in 2002 after being exposed to asbestos during summer jobs at Common Motors 30 years ago. The award was the largest in Recent Jersey history for an asbestos exposure case.

Buttitta’s widow brought a lawsuit against Allied Signal as well as other suppliers to the Common Motors warehouses where her husband had worked, as well as all but two of the companies settled before the jury verdict in 2008. Borg-Warner Corp., one of the companies that hadn’t settled, appealed the verdict.

By upholding the verdict, the appeals court reaffirmed that even minimal, infrequent exposure to asbestos can cause deadly diseases similar mesothelioma that may not develop for decades.
